Terms of Service

Welcome to our Terms of Service. These terms outline the conditions under which you may use our website and services.

Welcome to Eclectic Villas

Please carefully review these booking terms and conditions as they form the foundation of our agreement with you.

Definitions

“You” or “Your” refers to the individual or group named in the booking confirmation. “We,” “Us,” or “Our” refers to PT. Global Tourism Group, trading as Eclectic Villas, located at Denpasar, Bali, Indonesia 80117.

Your Agreement with us

By making a booking, you agree to be bound by these booking terms and conditions. The individual named on the booking confirmation assumes responsibility for all other individuals occupying or visiting the accommodation during the booked period. The person making the booking must be at least 18 years of age.

Maximum Occupancy

The maximum occupancy for each accommodation is specified in your booking confirmation letter. Please adhere to these limits to ensure the comfort and safety of all guests.

Child Definitions

  • Infants and children aged 0–11 years can share existing bedding with their parents free of charge.
  • Children aged 12 years or older are considered guests and must have their own bed, even if they share bedding with other guests.

Consequences of Exceeding Occupancy Limits

Exceeding the maximum occupancy limits can strain facilities and lead to potential damage. Therefore, we reserve the right to apply additional charges for extra guests or require any excess guests to vacate the premises without compensation. Please note that our maximum occupancy policy is strictly enforced.

Extra Bed Charges

  • Extra bed: Rp. 250,000 per night
  • Extra person (including bed): Rp. 500,000 per night

Child Hire Equipment

While most properties do not provide cots, high chairs, and other infant equipment, we can arrange for their rental through trusted third-party providers. Please contact us for pricing and availability, as options may be limited during peak seasons.

Events & Gatherings

Prior to hosting any event, party, function, or gathering at the property that exceeds the maximum occupancy limit, you must obtain our written permission. In most cases, additional terms and conditions will apply, including extra cleaning and security fees. Not all events will be approved.

Payment Policy

Credit Card Verification

Upon check-in, the credit card used for the booking must be presented along with the cardholder. If the card is lost, stolen, or expired before arrival, contact us to process payment using a replacement card.

Direct Bookings

  • Bookings within 30 days of arrival require full payment at the time of booking.
  • Bookings more than 30 days in advance require full payment within 72 hours of booking.

Third Party Bookings

Refer to your booking confirmation letter for payment details. Contact your booking agent or other third party directly for payment inquiries.

Payment Methods

  • Cash (Indonesian Rupiah only)
  • Bank transfer
  • Visa, Mastercard or JCB card

Credit Card Transactions

  • Credit card transactions will appear on your bank statement as Eclectic Villas / PT Global Tourism Group / or the property name (e.g., The Elok Villas).
  • All credit card transactions must be processed in Indonesian Rupiah (IDR).
  • Other currencies will be converted to IDR using the Xe Currency Converter at the time of the transaction.

Additional Charges

  • Your bank may impose additional fees beyond our control.
  • You are responsible for charges/fees due to bank transfers.
  • Any shortfall due to fees must be settled upon arrival.

Booking Amendments

Direct Bookings: Notify us promptly in writing for changes. We’ll try to accommodate but cannot guarantee fulfilment. Additional costs may apply (e.g., season change).

Administration Fees

  • > 60 days before arrival: 10% of original booking value
  • > 30 days before arrival: 20% of original booking value
  • Within 30 days: Not permitted

Third‑party Bookings: contact your agent; we cannot assist with third‑party reservations.

Booking Cancellations

Direct Bookings: Cancellations must be in writing; effective on the date received. Charges increase closer to check‑in.

Cancellation Charges

  • More than 60 days before arrival: 75% refund
  • Within 60 days of arrival: 50% refund
  • Within 30 days of arrival: 25% refund
  • Within 7 days of arrival: No refund

Refunds: processed within five (5) business days after written cancellation (see Refunds). Third‑party bookings: contact your agent.

Booking Cancellations by Us

In rare instances we may modify/cancel due to repairs, refurbishment, or events beyond control (e.g., fire, storm, property sale).

  • Alternative Accommodation: If none suitable or declined, full refund within five (5) business days.
  • Cost Adjustment: Higher alternative rates payable by guest.

Force Majeure

Notification

Affected party must promptly notify the other in writing, detailing the event and impacts.

Options

  • Reschedule (subject to availability; rate differences may apply).
  • Receive a voucher equal to the original booking value.

Refunds

No refunds for force majeure cancellations unless the property becomes uninhabitable.

Travel Insurance

You are responsible for obtaining comprehensive travel insurance (including force majeure coverage).

Interpretation & Application

We reserve the right to interpret/apply the policy at our discretion, in good faith and fairly.

Refunds

Bank charges/fees are deducted from refund. Card refunds typically 14 days, up to 30 days depending on banks.

Check-in

Check‑in from 2:00 pm (14.00 hrs).

Prior Arrival Notification

Please inform ETA at least three (3) days in advance to ensure staff availability to greet you and provide keys.

Guest Identification & Registration

We will require a copy of each guest’s passport or KTP on arrival (Immigration Act Number 6, 2016, Article 72 (1)(2)). Guest Registration Form must be completed and terms signed; failure may result in immediate termination without compensation.

Compulsory Security Bond

Rp. 2,500,000 security bond (or equivalent) upon arrival, via cash or card pre‑auth; refunded minus damages/incidentals. Pre‑auth releases can take up to 14 days.

Exceptions

  • Villa Lacella, Canggu: Rp. 5,000,000 deposit.
  • Airbnb bookings: no bond (covered by Airbnb AirCover for Hosts).

Damage & Loss Reporting

Report missing/damaged items upon arrival; otherwise we may assume responsibility. You are liable for losses/damages by you or your guests; pay any excess beyond the bond immediately.

Charges for Lost Keys

Rp. 500,000 per set (includes cylinder replacement, duplicate keys, and tag).

Charges for Linens & Towels

Use linens & towels with care. Items stained with makeup, spray tans, lotions, henna, ink, blood, wine, coffee, etc. will be charged at new replacement cost:

Report pre‑existing stains immediately to avoid liability. Charges also apply for lost items.

Rights of Access

We may access the accommodation for unforeseen problems, to investigate complaints, or to perform routine checks/maintenance (e.g., pool testing). We aim for reasonable times except emergencies.

Guest Conduct & Responsibilities

  • Keep the accommodation clean and tidy and leave it as when you arrived.
  • Immediately notify staff of any damages or breakages.
  • No dangerous, offensive, noisy, illegal or immoral activities.
  • Do not cause nuisance to neighbours (see Quiet Hours).
  • Follow local regulations and respect the community.
  • Secure doors/windows when absent.
  • No smoking indoors (Rp. 2,500,000 charge).
  • No durian on property (Rp. 2,500,000 charge).
  • Dispose of garbage in provided bins.
  • Minimise water/electric usage when away.
  • No pets unless prior written consent.

Quiet Hours

11:00 PM – 8:00 AM. Keep noise to a minimum (music/TV, conversations). Close doors/windows to reduce transmission.

Consequences of Excessive Noise

  1. We may ask you to reduce noise.
  2. We may issue a formal warning.
  3. We may exercise our rights to evict you and your party.

Right to Evict

We may terminate our agreement and ask you to leave immediately if you commit a serious breach, endanger safety, receive complaints for anti‑social behaviour, cause unreasonable damage, or exceed maximum occupancy. No refund/compensation.

Liability for Damage, Loss, or Injury

Limited Liability: We and the property owner will not be held liable unless damage/loss/injury is conclusively caused by our proven negligence. Liability is limited to a maximum combined total of IDR 5,000,000.

Travel Insurance: You acknowledge responsibility to obtain comprehensive travel insurance.

Child Supervision and Safety

Parents/guardians are solely responsible for supervising children at all times, especially around pools, ponds, and other water. We are not liable for injuries or fatalities from drowning or accidents in/around these areas.

Lost Property

Notify us promptly for any belongings left behind. We may charge storage/delivery. Items retained for one month, then disposed of responsibly.

Uncontrollable Disturbances

Electricity & Wi‑Fi Outages

Disruptions may occur due to maintenance or technical issues. We will work to restore services as quickly as possible.

Intruding Wildlife

Bali’s biodiversity includes stray cats, rats, bats, geckos, lizards, roaches, and mosquitos. While preventive measures are taken, presence can occur.

Ambient Noise

Potential disturbances include religious ceremonies, local animals, neighbouring properties, clubs, bars, and restaurants.

Construction Noise

Ongoing development may lead to occasional construction noise. We will inform guests of known projects. No liability or compensation for such disturbances.

Check-out Time

Check-out time is at 1100 hrs (11:00 AM).

An extension of your check-out time is subject to availability and requires prior approval from us on the morning of check-out.

  • Extensions up until 1800 hrs (6pm) will incur a 50% charge of the published nightly rate.
  • Extensions after 1800 hrs (6pm) will incur a 100% charge of the published nightly rate.

If you do not leave the accommodation by the pre-approved departure time, we reserve the right to remove your belongings from the property and apply the above-mentioned late check-out charges.

Addressing Issues & Complaints

  • Reporting Issues: Notify staff promptly so we can rectify.
  • Complaint Resolution: We strive to address complaints promptly and fairly. We cannot entertain complaints lodged after departure.
  • Uncontrollable Disturbances: We will take reasonable steps to minimise disturbances by communicating with parties or contacting authorities.
  • Respectful Conduct: Treat staff and representatives with courtesy and respect. Abuse will not be tolerated.

Personal Data Protection

We collect personal data necessary to process your booking and provide services, limited to relevant and necessary purposes.

  • Communicate booking confirmations, updates, and relevant information
  • Ensure safety and security of properties and guests
  • Comply with applicable laws and legal obligations

Data Security Measures

We implement reasonable security measures to protect your personal data against unauthorised access, loss, alteration, or disclosure.

Data Retention

We retain personal data only as long as necessary for the purposes outlined or as required by law, after which it will be securely disposed of or anonymised.

Data Sharing and Disclosure

We may share personal data with third parties who assist in providing services (e.g., payment processors, property owners, service providers) with appropriate protections.

Marketing Communications

With your explicit consent, we may send offers, promotions, or newsletters. You may opt out at any time.

Your Rights

You may request access, rectification, or deletion of your personal data as permitted by law.

Changes to the Privacy Policy

We may modify or update this clause from time to time. Material changes will be notified through appropriate means.

Governing Law & Jurisdiction

This clause is governed by the laws of Indonesia. Disputes are subject to the exclusive jurisdiction of Indonesian courts.

Travel Insurance

You acknowledge responsibility for obtaining comprehensive travel insurance (including cover for force majeure) to protect against unforeseen circumstances before, during, or after your stay.

Updates to Booking Terms & Conditions

These booking terms and conditions were last updated in June 2024. We may modify or update these terms at any time without prior notice. By continuing to use our services, you agree to the latest version of these terms.
